Terms + Conditions of Hire
1. Definitions.
The ‘Hire Company’ is The Table Station.
The ‘Client’ refers to any individual, firm, or corporation hiring equipment or appoints services from the ‘Hire Company’.
The ‘Equipment’ refers to all Marquees, furniture, props, homewares, decor, lighting and accessories supplied to the ‘Client’.
The ‘Event date’ is the day of the wedding or event supplied by the client to the hire company.
2.CONDITIONS OF HIRE
The hiring of equipment is done on a first to book basis. To secure the equipment for your booking the deposit needs to be paid by the due date given and an original term and conditions to be signed and returned to the Hire Company. Should both these not be done by the due date the Hire Company has the right to hire any equipment to another client. Hiring of the equipment will begin from the commencement date specified by the hire company and shall be collected or returned to the hire company by the date specified by the hire company. Any extension of the period needs to be agreed to by the hire company and may incur additional fees.
By making a booking through confirming a quote via signature, deposit payment or remittance of funds, the hirer acknowledges and agrees to the Owners Terms and Conditions.
3. QUOTATION
All Quotations are valid for 14 days from the date of issue. Quotations that are not accepted within the time identified may be subject to amendment. All prices are in Australian Dollars. Additional details, not provided at the time original quotation may result in additional costs.
4.PAYMENT
(a) The hirer agrees to pay The Table Station the hire fee and the damage waiver fee specified for the equipment for the hire period including any applicable GST, stamp duties, penalties, levies or freight and other charges relevant to this agreement.
(b) The required fees must be paid to The Table Station prior to the commencement date of the hire period.
(c) Equipment not returned on time and in accordance with this agreement will be subject to a continuance of the agreed rental until return is complete.
(d) Payment for hire of goods must be made by; (i) 50% of the agreed hire price upon confirmation of order; and (ii) the balance of the agreed hire price made 14 days prior to delivery of the goods. Payment must be made by credit card, bank transfer or cash.
(e) The Owner requires security details at the time of order placement. An order will not be confirmed until and unless security detail is endorsed and supplied to the Owner.
(f) All orders placed less than 14 days from delivery require full payment to confirm the booking.
(g) All prices on the The Table Station website are in Australian Dollars (AUD).
(h) All custom built or special purchase equipment requires full payment at point of booking in order to commence manufacture or buying process.
4.DEPOSIT
A non refundable 50% deposit (50% of the total booking amount including GST, delivery fee and setup fee) is required at the time of the booking. Final payment of the remaining 50% of the total booking cost shall be paid 14 days prior to the event date. All payments must be made by the direct deposit into the hire company’s bank account and by the due date specified. Please note that should the final payment not be made 14 days prior to the event date the hire company reserves the right to no longer supply any equipment for the event. No deposit will be returned should this occur.
5. CANCELLATION POLICY
The Hirer may cancel an order but may forfeit any hire fees paid as follows:
(a) If your booking is cancelled 4 weeks before the event date, The Table Station we will retain the initial 50% non-refundable deposit, and the remaining amount will be re-paid in full.
(b) If your booking is cancelled or item quantities reduced within 14 days of the event date we will retain 100% of the total hire fee.
(c) Wet weather - unfortunately we are unable to provide a refund in the event of inclement weather. If your event is outdoors we recommend a backup plan to hold your event indoors and undercover. We will happily deliver and set up in an alternative venue within 10km.
6. SECURITY BOND
The hire company reserves the right to request a security bond to cover any equipment. The bond and amount will be determined by individual booking requirements. Any damaged, missing, very unclean items will be charged at full replacement cost and/or cleaning cost will then be deducted from the bond amount.
The security bond is payable by the Hirer to cover all costs associated with normal wear and tear to the equipment hired, the waiver does not apply to any other damage including:
(i) damage resulting from overloading, exceeding rated capacity, misuse, abuse or improper servicing of equipment;
(ii) Damage due to mysterious disappearance of the equipment;
(iii) Damage caused by the use or operation of equipment in contravention of any of the conditions of the agreement;
(iv) Damage to, or loss of, the equipment from any unknown cause.
(v) Cigarette burns on any furniture or décor items.
(vi) Red wine spillages on any furniture or décor items.
7. DAMAGE, LOST, STOLEN OR UNCLEAN EQUIPMENT
(a) The Hirer is responsible for the equipment from the time of delivery until collection by the Owner and shall pay for all equipment damage or loss however caused during that period.
(b) The client will pay full replacement cost of any equipment badly damaged, lost or stolen. The client will pay any repairing costs to damaged equipment. Any damaged equipment will be decided by the hire company if it can be repaired or require replacement. Burns, holes, tears, water damage or other similar damage to equipment shall be replaced at full cost to the client.
(c) It is the clients responsibility to notify the hire company should the equipment not be in a satisfactory condition within 6 hours of receiving the equipment. Otherwise any damage or uncleanliness of equipment shall be deemed the clients accountability.
(d) The client shall protect the equipment from the elements during the time of hire. In poor weather conditions storage of the equipment may be necessary and is the responsibility of the client to see that the equipment is stored safely. Any equipment damaged from weather is the full responsibility of the client and shall be paid at full replacement cost to the hire company.
(e) Any equipment returned unclean by the client to the hire company, the client shall pay the hire company the full cost of returning the equipment to a clean condition.
The Owner shall not be liable for any loss or damage caused to any person, property, animal or things whatsoever arising from the use of the equipment hereby hired and the Hirer indemnifies the Owner in respect to any claims for such loss or damage.
Any person signing the documents for and on behalf of the Hirer hereby covenants with the Owner that he or she has the authority of the Hirer to make this agreement on the Hirer’s behalf and is empowered by the Hirer to bind the Hirer to this agreement and hereby indemnifies the Owner against all losses and cost incurred by the Owner arising out of the person signing this agreement failing to have such power and/or authority.
Where the Hirer is more than one person liability shall be joint
8 DELIVERY COLLECTION AND SETUP
Fees will be charged to the client for any installation of equipment, delivery and collection. This fee will vary depending upon distance traveled from the hire company’s premises, amount of equipment hired, amount of setup required and installation time. The client will be advised of the fee once all equipment has been decided upon. This fee may be subject to change should the client then change the amount of equipment hired or amount to be setup. Unless a setup fee has been charged and agreed upon by the hire company the hire company in not responsible for the set up of equipment.
The goods shall be returned in a reasonably clean, but not necessarily sterile state or a cleaning fee may apply.
The Hirer must allow any The Table Station representative access to the goods at all reasonable times.
The Hirer must provide safe and proper access to and at the event site.
The Hirer is liable for all injury, loss or damage suffered by The Table Station, its employees or agents while at the event site.
Prices quoted are for delivery on street level. Extra charges shall be payable for delivery to and removal from higher or lower levels.
The hirer agrees to ensure that any site specified on the hire agreement, will be clear of all obstructions to allow The Table Station to erect, install or place the hire equipment safely.
9 DISCLAIMER
The hire company shall in no way be held responsible or accountable for any injury, death or loss of income caused to the client, any third parties or properties due to the hire of equipment or provided services by the hire company.
10. FORCE MAJEURE
For the purpose of this clause, “Force Majeure” means an event or circumstance beyond the reasonable control of a party, including, but not limited to, acts of God, War, Rain, Hail, Wind, Fire, Explosion, Civil disobedience, Legislation not in force at the date of this Agreement or labour disputes. Neither The Table Station nor the Hirer will breach this agreement and each party will not be liable to the other party for delay or failure to perform its obligation under this agreement due to Force Majeure. The Table Station may give written notice to the Hirer, giving full particulars of such Force Majeure.
The Table Station shall not be liable for any indirect or consequential losses or expenses suffered by the Hirer, including but not limited to, loss of turnover, profits, business or goodwill or any liability to any other party or for any loss or damage suffered by the Hirer as a result of any delays caused by such Force Majeure events.
